As the estimated wait time for mainland Chinese-born investors now stretches toward 10 years due to retrogression, USCIS has reaffirmed its requirement that EB-5 funds be maintained “at risk” for the full period of visa adjudication. The resulting need for a flexible and compliant reinvestment solution after the initial development project is finished — otherwise known as “redeployment” — has perplexed and challenged industry players, and the June 2017 update to USCIS’s Policy Manual tried (with limited success) to clarify the matter.

Ultimately, redeployment may be a viable way to maintain EB-5 investor funds “at risk” in light of the ever-increasing visa backlog. But it is a risky solution.
